Mississippi Health Insurance Laws and Regulations

Mississippi health insurance companies are not required to accept every application. They will look at an applicant's health history and pre-existing health conditions before setting the monthly premiums.

Federal laws do protect individuals who have left a group health plan with a former employer. Under HIPAA, Mississippi health insurance companies aren't allowed to impose an exclusion period or waiting period for a pre-existing condition. Another law, COBRA, gives former employees the right to stay on their group plan for a temporary period of time.

But the state's high-risk pool, the Mississippi Comprehensive Health Insurance Association, guarantees Mississippi health insurance coverage for residents who are turned down for private insurance.

Mississippi health insurance law also governs the coverage insurers provide. All Mississippi health insurance plans are required to cover certain health care services, such as:

  • Mammograms
  • Diabetes treatment
  • Vaccinations for children

Mississippi health insurance law also requires insurance companies to set coverage limits and maximums for mental health conditions equal to physical health conditions.

Mississippi Health Insurance High Risk Pool

Residents in Mississippi with pre-existing conditions will be able to have health insurance coverage from the temporary high risk pools set up by the Patient Protection and Affordable Care Act.

The Pre-Existing Condition Insurance Plan (PCIP) in Mississippi will run like normal Mississippi health insurance plans and require enrollees to pay monthly premiums and out-of-pocket costs.

Those eligible for the Mississippi PCIP will pay around the same amount that people without medical conditions pay for health insurance. The estimated monthly premium costs for Mississippi residents will be $277 for ages 0 to 34; $332 for ages 35 to 44; $424 for ages 45 to 54; $590 for ages 55 and older. The deductible for PCIP is $2,500 a year with an out-of-pocket limit set at $5,950 a year.

People with medial conditions can get health insurance for provider visits, prescription drugs, emergency services and more.

Individuals may apply for the Mississippi PCIP if they have been denied health insurance coverage due to a medical condition, have been uninsured for six months and are a United States citizen.
