Florida Health Insurance Laws and Regulations

Health insurance plans are regulated mostly on a state-to-state basis. This is an overview of a few of the laws and regulations for Florida health insurance.

In the Sunshine State, residents have guaranteed access to Florida health insurance coverage in certain situations. You cannot be denied coverage if:

  • You were diagnosed with breast cancer and completed treatment more than two years prior
  • You were fully covered by a group health plan for at least 3 months
  • You are HIPAA-eligible
  • You move out of an insurance company's service area and are looking for a new plan

Also, small groups of 1 to 50 people are guaranteed acceptance to a Florida health insurance plan.

The federal law COBRA (Consolidated Omnibus Reconciliation Act) gives any Florida resident the right to continue group health insurance coverage if he or she leave a job that provided group coverage.

Florida health insurance law also requires all health plans cover certain medical services. Those services are:

  1. Screening for breast cancer
  2. Care for some diabetes-related conditions
  3. Continuity of care for pregnant women
  4. Vaccinations for children

Florida health insurance plans must also set the same coverage limits and maximums for mental health conditions as they do physical health conditions which is known as mental health parity.

Florida Public Health Insurance Programs

These Florida health insurance programs are designed to provide coverage for low-income residents:

  • Medicaid

  • Florida KidCare

  • Mary Brogan Breast and Cervical Cancer Program
    The Mary Brogan program provides some women in Florida with screening for breast and cervical cancer. If diagnosed with breast or cervical cancer, eligible women can receive full health insurance coverage though Medicaid.
