Alabama Health Insurance Laws and Regulations

The individual health insurance market in Alabama is largely unregulated. State law does not require guaranteed issued coverage for any kind of health insurance plan. There is also no high-risk pool for Alabama residents who have health conditions.

Group health insurance under state law is, however, guaranteed issue for small groups of 2 to 50.

All policyholders in group health plans in Alabama are protected under the federal law HIPAA. If eligible, residents qualify for the Alabama Health Insurance Plan, which requires no waiting periods for any pre-existing health condition.

Alabama residents also have a right to COBRA coverage, if eligible. Because the federal law makes employees eligible for COBRA only in companies with more than 20 workers, Alabama has enacted a state expansion law which allows those employees have access to COBRA coverage.

State law does require Alabama health insurance plans to cover cancer screening for prostate, breast and colorectal cancer. There is also mental health parity in Alabama, which means mental health conditions are required to have the same coverage limits as physical conditions.

Also under Alabama health insurance law, insurance companies are allowed to consider pregnancy a pre-existing condition and may restrict coverage.

Alabama Public Health Insurance Programs

There are a few different Alabama health insurance programs that provide coverage for low-income residents. They include:

  • Medicaid
    This is the federal and state health care program for low-income children, pregnant women and adults. Health benefits for Medicaid are administered and regulated on a state-to-state basis.
